TLDR: This run is going to end with the cannabis stocks back down 50-80% or more from the levels they are at. $CRLBF is the real play here for the smart players that want USA exposure to the legislation. We just like the stocks now, not later.

Yeah I'm talking to the newbies specifically because the OGs here already know everything I'm about to share, but your insufferable groupthink and movement mentality shit pissed me off enough to make a post. Don't post DD if you have no clue. Ask someone for help and take your ridicule until someone comes along to help you.
I used to post weekly DD on Sunday here a couple of years ago before one of you literally contacted my wife IRL. Not even kidding. So I made a new account. This is my first contribution back and I'm going to try and ensure some of you don't blow your chance at massive gains here by explaining what is actually going on.
CNBC and anybody telling you that this is just 'momentum' and 'sentiment' is lying to you. The hedge funds are playing these right along with us. Don't ask me for proof, this isn't Twitter. Reasons why they are playing with us:
  1. When there is money to be made, hedge funds and HFT funds are there before you
  2. The floats are so small on these they can take sizable positions on both sides and stand to have massive gains, all the while handing you guys the bags.
That's all you need to know.
So in response to all you posting "real DD" with why these companies are the best and you're going to hold to the moon and never sell:
I'm over it -- I can tell instantly how uninformed you are when I read some poorly thought out DD about why CGC or TLRY or APHA is a long term play because they're talking about USA legislation. These are Canadian companies. Get your head back on straight. You're here for the trade and the bet, not for the fundamentals, and if that's it, then fine, ignore the rest of this post and pick an exit, and if not, read on so you don't hold more bags.
This place has never been one to care for fundamentals, but let me talk some sense into you so you can post some gain porn and I can tell you to fuck off instead of you guys all yelling "MaNiPuLaTiOn ShOrT LaDdErS"
Let's take a look at some of today's gainers:

$USMJay - Penny stock, worth absolute nothing for a reason
$SNDL - Up ridiculous amount, have a billion shares outstanding, just diluted them all the other day
$TeeRTeeC - Terra Tech, they grow weed, from all indications, do it poorly
$OhGeeEye - lol
$HUGE - Probably the only one in the lot worth a YOLO on the chance they get an acquisition like GW Pharma did but they don't have the same product portfolio or prospects GW has.

Now, if you're simply playing this to get in and get out, great for you. The people saying (and believing) "$SNDL $10 EOW! HOLD THE LINE" and stuff like this are just absolutely brand new normies and are clueless, do not listen to them. If you yolo'd on cheap calls in Dec/Jan, congrats, take your gains and don't be like the $GME bagholders.
If you're investing in any of the names I just posted above, expect any money you put in to at some point in the next 12 months be worth approximately 20% of what it is worth now. Literally. They're far worse than the main bunch (CGC, CRON, ACB, TLRY, APHA) but the main bunch is nothing to write home about either.

THIS IS WHAT IS REALLY HAPPENING:

Tilray had 40% short interest. It's not $GME level, but it's pretty high. When the stock crested $40 it really started taking off, why though? Notice this week's FD option chain:

Tilray has a 95M share float, those 42 calls represent roughly 1.5M shares held as a hedge just by themselves. Previous to this run up, that represents roughly 5% of the average daily volume of the stock, BY ITSELF. Those are shares that until Monday can be considered removed from the float because they're held as a hedge. They may get loaned out to be shorted, but that will only speed up the squeeze here.
The important part: Today (2/10/21) the stock fell hard after open down to around 44 and found massive support all the way back to up 66. The most sold front week call? $40/$42 strikes. Premium when I screen shotted this? $22.20. Stocks going to pin above $60 for awhile likely, unless people are stupid enough to buy the OTM calls, in which case, it may squeeze itself higher.
Smart hedge funds are going to pile into this, sell you the calls, shove the price up to keep selling you calls, then watch them all evaporate worthless in one of the future weeks in the chain, dump back the shares to help shove the price down, oh and did I mention? They shorted the top.

It's just another plain old stock acting as a derivative of the option chain gamma squeeze. That's it, with a bit of short squeeze thrown in there and a WHOLE BUNCH of WSB fomo. The shorts are covering and pushing up the volume, likely re-shorting on the way up, and then you have WSB fomo'ing in to round out the total: a massive volume of 200 million shares today. You've got people that think this thing will skyrocket to 500+ (and it may) but the stakes get higher and higher each ladder up you take and the moves become more violent and more likely it comes all the way back down in short time the quicker it goes up.
Might it get there? Sure. But be prepare to take profits when it does because...

ITS CALLED MEAN REVERSION. THIS CANT GO ON FOREVER.

Not to mention, the moves you are seeing are in completely overvalued companies, with horrible fundamentals, and poor prospects.
Oh what's that? CGC got some CBD treats for Martha, seems fitting that something ill is going on in this industry considering she went to prison for insider trading. If the dog treats get you excited about the stock, Martha belongs here more than you do.
200M shares today means people who were long term bag holders cashed out and the shares have turned over the float two times in two days. That also means the shorts have turned over and are now short again. It means the HFT firms are feasting on all of you. It means Citadel is making a pile on the spreads.
What to take away: An amount of shares equal to the entire float has changed hands, or in other words, fewer reason for people to bag hold. Fewer people that have to hedge. Fewer people that have to cover. Fewer people to help stabilize any of these upper price tiers, and keep the price stable by holding, and more reason it's going to collapse sooner (or later).
But, this IS a casino after all...

Looks eerily familiar to something else recently. Last time this occurred it traded between $100 and $300 in a single week timeframe.
For those of you that are new: THIS IS NOT NORMAL. STOCKS DO NOT ALWAYS DO THIS. You are in the infancy of a new age of trading, but people still know, fundamentals matter a whole lot more than everyone is leading on, and these valuations are getting extremely overextended.
Eventually, in the first squeeze Tilray bled off until the pandemic hit and it piled down to $2.43 a share. At $2.43/share, I would have bought it. Even at $10/12/14. At these levels? You're just ultimately out of touch but I look forward to the loss porn.
So in short, again: Sir, this is a casino.

Timeline of events, and how to not become a bagholder:
  1. $APHA earnings are good, stocks pop a bit, and level off
  2. Legislators pull a pump and dump since they probably have calls and say planning on some laws regarding changing the schedule of cannabis (notice: we will likely NOT get outright legalization, just re-scheduling)
  3. $CGC earnings are actually awful, with the caveat they have profitability on the horizon
  4. $TLRY gets a UK deal
  5. $TLRY starts going insane - since $APHA is a reverse merger with a .81 value share to share, it starts pumping, people start buying the lower priced cannabis stuff and entire sector starts moving on "overall strength"
  6. There's no strength, there's a gamma squeeze backed by investor momentum, and a short squeeze on Tilray.
  7. This is going to come back down violently then plateau out like GME and pull a slow bleed the rest of the way back down, just like the second graph I posted. There is no fundamental or even POSSIBILITY of better fundamentals immediately on US legislation. The cost to enter the US market will most definitely cause capex and goodwill capital outflows, and set back their profitability since there are established MSO's in the USA already. The USA opening the market to these companies will only further degrade the actual balance sheets/income statements and slow down profits and you know what institutions and shareholders like? Yep. Profits.
  8. Finally, how to not become a bag holder: The market can stay irrational way, way, way longer than you expect. So this may go on for a bit, but refer back to 7. It's coming back down eventually, set expectations and pick your exit, or start to shave off your position as it goes up and let a portion of it run. Eventually, you have to sell to actually realize a gain, don't forget that. Once you do, close the chart, remove it from your watchlist, check back in on it in a month if you want to get back in when you have a clear head.
The Canadian operators are literally the last companies I'd play off a US legislation play, and one of the only ones worth owning in $APHA for the arbitrage play on the shares. But if Tilray comes crashing back down, $APHA will as well along with all of them, and you have to hope you lose a lot less on $APHA crashing than you'll make on the arbitrage between the share price.
THIS IS ALL JUST "SENTIMENT" BASED YOLOING BY THIS SUB. It has probably driven uneducated retail into the trades also - who will also become bag holders.

These prices are insanely high for these companies. The multiples are out of control, and if you buy in at these levels, well, best of luck, I hope it works out for you. I'm fighting the fomo of extended gains, and will continue to put my money elsewhere.

Edit: You know what I forgot to add? Some of the biggest holders, the cannabis ETFs and funds, you know what they did today? They trimmed their positions. And they will continue to do so because of fiduciary responsibility and when you de-concentrate shares into the retail's hands, the moves will get more and more finnicky and more and more violent.

You know what "lets push this to the sky" sounds like? Market manipulation. We're not in this together, I literally handed one of you a bag to hold this morning and even if they go up for another month, eventually, that bags gonna be heavy and I ain't coming back for it. I ain't tipping you either.
These prices are insanely high for these companies. The multiples are out of control, and if you buy in at these levels, well, best of luck, I hope it works out for you. I'm fighting the fomo of extended gains, and will continue to put my money elsewhere.

Edit: You know what I forgot to add? Some of the biggest holders, the cannabis ETFs and funds, you know what they did today? They trimmed their positions. And they will continue to do so because of fiduciary responsibility and when you de-concentrate shares into the retail's hands, the moves will get more and more finnicky and more and more violent.

Yeah, I think these are coming back down in price sooner rather than later, that isn't extraordinary information for a common sense person.

DraftKings (NASDAQ: DKNG) - Deep Dive Research - Part 1

TL:DR
Hello, welcome to my first deep dive write up.
My name’s Mark and I’m an accountant with a passion for investing. About two years ago, I used to work as an auditor at a public accounting firm and have been behind the scenes at many different publicly traded and privately held companies in the U.S. My goal is to bring my unique perspective from that past experience, my current experience working in a new role at a large corporation, and my understanding of accounting to help break down some of the most exciting growth stocks on the market today.
I’m a long-term investor. I am focused on finding great companies and holding them for a long time. I’m willing to endure volatility, crazy price drops, and everything that comes with this approach as long as the facts that led me to originally invest and believe in that company have not changed. Introduction
I think it’s fitting that my first stock pick has to do with sports. Sports has been a part of my life since I could walk at the age of 2. First with baseball and soccer, and then later in my childhood with golf. I’ve always played American football and basketball for fun as well and have always been an avid fan of all the major sports in the US.
I started playing fantasy sports (mostly just fantasy football) about 6 years ago and have always enjoyed it. Traditionally, with fantasy football you draft a team at the beginning of the year and those are your players for the rest of the season. If you have a bad draft, oh well. You can try to improve your team with trades and free agent additions but it is tough. Leagues usually consist of 10-14 teams (each managed by an individual) and there’s obviously only one winner at the end of the season (about 4 months after the draft). This can lead to the managers of the lower performing teams losing interest as the season wanes on. I believe DraftKings’ (DK) founders saw this issue and saw an opportunity. Enter, daily fantasy sports. Now, with the DK platform you can draft a new team every week. Or if you want, every day. This allows fans of fantasy sports to engage at whichever point of the season they want and at varying financial stakes.
The Thesis Statement
For every stock pick I make, I want to provide a quick thesis statement that can serve as a reminder for why I’m buying and holding that stock for the long term. I’ll always aim to make it just a few sentences long so it can easily be remembered and internalized. This helps during times when the price may sporadically drop and you need to remember why you’re holding this position.
The thesis statement I have come up with for DK is as follows:
“DraftKings: The leader in allowing fans to engage financially with their favorite sports, teams, and players. Having money at stake makes the game a lot more interesting to watch. The era of daily fantasy sports games, online sports betting, and online betting (outside of sports), is just getting started and DK is as well positioned (or better positioned) than anyone to capitalize off of this trend.”
Notice how I said “allowing fans to engage financially” as the first sentence and not necessarily “allowing fans to gamble”. There’s a reason for that. According to US Federal Law, Daily Fantasy Sports (DFS) contests have specifically been exempted from the prohibitions of the Unlawful Internet Gambling Enforcement Act (UIGEA). DK has always been, and I believe will continue to be DFS contests 1st, sports betting 2nd, and other forms of gambling/entertainment 3rd. It is noteworthy that states at an individual level can still deem DFS contests illegal if they so wish, but as of this writing (11/26/20), 43 of the 50 US States allow DFS contests and DK, accordingly, is offering DFS contests in all 43 of those US States.
I’ll try to clarify the difference between DFS contests and sports betting real quick:
DFS Contest – Pay a pre-set entry fee to enter a contest. All entry fees go towards “The Pot”. “Draft” 9 players to be on your “Team” for 1 week. Enter your “Roster” into a contest with other players (could range from 1 other person to 1,000s of people, the DK user can choose). Whichever “Roster” amasses the most points for that week out of all contestants wins. The winner will get the highest payout, and depending on the nature of the contest, other top finishers will receive smaller payouts as well.
Sports Gambling – Team A is considered a 10 point favorite to defeat Team B. This means that Team A is expected, by the professional gambling line setters, to outscore Team B by 10 points. This is known as a point spread. You can bet on the underdog or the favorite. If you bet on the favorite, they have to win by more than 10 points for you to win the bet. If you bet on the underdog, you will win the bet as long as the underdog keeps the game within less than a 10 point defeat.
These are just a couple simple examples to help you see the difference. Sports Gambling (the 2nd priority of DK) is a very lucrative market just as the DFS contests are. However, in the US, Federal Laws and regulations are a lot stricter on Sports Gambling than they are on DFS. As of this writing (11/27/20), 22 states (including the District of Columbia) out of 51 possible allow sports gambling.
DK is still in the infancy stages of getting their sports gambling business going. In the 22 states where they could potentially operate, they currently have a sports gambling offering in 11 of those states. The sports gambling business model for DK can be broken into two main offerings – mobile sports betting, and retail sports betting. Mobile sports betting means you can place a sports bet online from the comfort of your own home, while retail sports betting means you must go to a casino and place a bet with the sportsbook in person. I personally believe mobile sports betting is the real potential cash cow for DK out of the two types of sports betting offerings due to the convenience and ease of access. DK is currently working on and encouraging customers to lobby their state lawmakers to legalize sports gambling in more states.
How DK makes money
At the very least, before you invest in a company, you better understand how they make money. In Chris Mayers’ excellent book, 100 Baggers, that I mentioned above, he continually references top line revenue growth as one of the main common indicators of a possible 100 Bagger. This isn’t to tell you that any stock I pick will be a 100 Bagger just because it has great top line revenue growth, but if I am looking at a growth stock to hold for the long term, revenue growth is one of the first things I look at.
For DK, their means of making money is quite simple. I already went into detail above about DFS Contests and Sports Gambling. In DK’s latest 10-Q filing with the SEC (filed 11/13/20), revenue is broken out into two main streams: Online Gaming and Gaming Software.
Online Gaming (82% of Total Revenue for 9 months ended 9/30/20):
Online gaming is the true core business of DK and includes the aforementioned DFS Contests, Sports Gambling and additional gambling (non-sports) opportunities. DK refers to their additional gambling (non-sports) as “iGaming” or “online casino”.
For the 9 months ended 9/30/20, Online Gaming revenue totaled $239M, up 30% YoY from $184M in the same prior year period. Keep in mind, that this is an increase that happened during a COVID-19 global pandemic that delayed and shortened many professional sports seasons.
Online gaming revenue is earned in a few ways that are slightly different, but very similar overall. In order to enter a DFS contest, a customer must pay an entry fee. DFS revenue is generated from these entry fees collected, net of prize payouts and customer incentives awarded to users. In order to place a sports bet (sports gambling), a customer places a wager with a DK Sportsbook. The DK Sportsbook sets odds for each wager that builds in a theoretical margin allowing DK to profit. Sports gambling revenue is generated from wagers collected from customers, net of payouts and incentives awarded to winning customers. The last form of online gaming revenue is earned in similar fashion to a land-based casino, offering online versions of casino games such as blackjack, roulette, and slot machines.
Gaming Software (18% of Total Revenue for 9 months ended 9/30/20):
While the Online Gaming revenue stream mentioned above is a Business to Consumer (B2C) model, the Gaming Software revenue stream is a Business to Business (B2B) model. The Gaming Software side of the business was born out of the acquisition of SBTech, a company from the Isle of Man (near the UK) founded in 2007 that has 12+ years of experience providing online sports betting platforms to clients all over the world. The acquisition occurred as part of the SPAC driven IPO in April of 2020 that combined “the old DK company” with SBTech so that they now are “the new DK company” listed as DKNG on the NASDAQ. SBTech is a far more important part of the story than just being 18% of today’s revenue. The reason for this is because DK will eventually (planned mid-late 2021) be migrating all of their DFS and gambling offerings onto SBTech’s online platforms. Currently, for DFS, DK uses their own proprietary platform but that will move to SBTech with the migration. Currently, for online gambling, DK uses Kambi, the same online gambling platform that services Penn Gaming (PENN), a DK rival. But that’s enough about the software migration for now, back to the Gaming Software revenue.
The Gaming Software revenue stream for DK is essentially a continuation of SBTechs’ B2B business model. DK contracts with business customers to provide sports and casino betting software solutions. DK typically enters two different type of arrangements with B2B customers when selling the gaming software:
  1. Direct Customer Contract Revenue: In this type of transaction, the software is sold directly to a business (casino for example) that wants to use the software for their own gambling operations. This revenue is generally calculated as a percentage of the wagering revenue generated by the business customer using DK’s software and is recognized in the periods in which those wagering and related activities conclude.
  2. Reseller Arrangement Revenue: In this type of transaction, DK provides distributors with the right to resell DK’s software-as-a-service offering to their clients, using their own infrastructure. In reseller arrangements, revenue is generally calculated via a fixed monthly fee and an additional monthly fee which varies based on the number of gaming operators to whom each reseller sub-licenses DK’s software.
As mentioned above, SBTech was an international company based in the Isle of Man before being acquired by DK. Thus, the majority of their business in their first 12 years of operating independently has always been international and outside of the United States. This has helped DK, which has historically been US focused, expand it’s international reach.
A perfect example of expanding this international reach occurred recently during October (technically Q4) in which DK’s B2B technology (powered by SBTech) helped enable the launch of “PalaceBet”, a new mobile and online sportsbook offering from Peermont, a South Africa based resort and casino company. The deal was headed by DK’s new Chief International Officer, Shay Berka, who previously spent 10 years working for SBTech as CFO and General Manager. Mr. Berka took on the role of DK’s Chief International Officer upon the merger in April earlier this year. I think this deal shows that DK has integrated SBTech and it’s business very well into the larger business as a whole. They are not wasting any time using their newly acquired resources to expand their reach and bring in new sources of revenue.

There's a lot of disinformation out there spread by foreign trolls and domestic militants. Qanon is nonsense but it serves a purpose of blunting the facts. "You say Trump was helped by the Russians? What about Hillary eating babies?"
A poster named Tobert420 put together a comprehensive list that worth reviewing before voting in the coming election. Since the goal of those spreading disinformation is to muddy the waters, I thought I would share his work. Knowledge is power.

► Trump was first compromised by the Russians in the 80s. In 1984, the Russian Mafia began to use Trump real estate to launder money. In 1987, the Soviet ambassador to the United Nations, Yuri Dubinin, arranged for Trump and his then-wife, Ivana, to enjoy an all-expense-paid trip to Moscow to consider possible business prospects. Only seven weeks after his trip, Trump ran full-page ads in the Boston Globe, the NYT and WaPO calling for, in effect, the dismantling of the postwar Western foreign policy alliance. The whole Trump/Russian connection started out as laundering money for the Russian mob through Trump's real estate, but evolved into something far bigger.
► In 1984, David Bogatin — a convicted Russian mobster and close ally of Semion Mogilevich, a major Russian mob boss — met with Trump in Trump Tower right after it opened. Bogatin bought five condos from Trump at that meeting. Those condos were later seized by the government, which claimed they were used to launder money for the Russian mob. (NY Times, Apr 30, 1992)
► Felix Sater is a Russian-born former mobster, and former managing director of NY real estate conglomerate Bayrock Group LLC located on the 24th floor of Trump Tower. He is a convict who became a govt cooperator for the FBI and other agencies. He grew up with Michael Cohen--Trump's former "fixer" attorney. Cohen's family owned El Caribe, which was a mob hangout for the Russian Mafia in Brooklyn. Cohen had ties to Ukrainian oligarchs through his in-laws and his brother's in-laws. Felix Sater's father had ties to the Russian mob. This goes back more than 30 years.
► Trump was $4 billion in debt after his Atlantic City casinos went bankrupt. No U.S. bank would touch him. Then foreign money began flowing in through Bayrock (mentioned above). Bayrock was run by two investors: Tevfik Arif, a Kazakhstan-born former Soviet official who drew on bottomless sources of money from the former Soviet republic; and Felix Sater, a Russian-born businessman who had pleaded guilty in the 1990s to a huge stock-fraud scheme involving the Russian mafia. Bayrock partnered with Trump in 2005 and poured money into the Trump organization under the legal guise of licensing his name and property management.
► In July 2008, the height of the housing bust, Trump sold a mansion in Palm Beach for $95 million to Dmitry Rybolovlev, a Russian oligarch. Trump had purchased it four years earlier for $41.35 million. The sale price was nearly $54 million more than Trump had paid for the property. Again, this was the height of the recession when all other property had plummeted in value.
► Semion Mogilevich was the brains behind the Russian Mafia. Mogilevich operatives have been using Trump real estate for decades to launder money. They operated card games, illegal gambling websites, and a global sports book and laundered more than $100 million. A condo directly below one owned by Trump reportedly served as HQ for a “sophisticated money-laundering scheme” connected to Semion Mogilevich.
► The Russia Mafia is part and parcel of Russian intelligence. Russia is a mafia state. That is not a metaphor. Putin is head of the Mafia. So the fact that they have been operating out of the home of the president of the United States is deeply disturbing.
► Rudy Giuliani famously prosecuted the Italian mob while he was a federal prosecutor, yet the Russian mob was allowed to thrive. The Putinists’ goal was to pass the resolution by Feb. There is no one on this side of the Atlantic who thinks the USSR was justified in invading Afghanistan. And out of nowhere, on January 2nd, Trump came out strongly supporting Russia's 1979 invasion of Afghanistan.
► Trump went against American intelligence on North Korean missiles. He told the FBI he didn't believe their intelligence because Putin told him otherwise. “I don't care, I believe Putin"
Trump met in secret with Putin at the G20 summit in November 2018, without note takers. 19 days later, he announced a withdrawal from Syria. As a note, Trump conducted FIVE completely private meetings and conferences with Putin, and has gone to great lengths to prevent literally anyone, even people in his administration, from learning what was discussed.
Trump refused to enforce sanctions legally codified into law - and in some cases reversed standing sanctions on Russian companies.

Coronavirus

Inspectors general warned Congress last week that the Trump administration is blocking scrutiny of more than $1 trillion in spending related to the Covid-19 pandemic. According to the previously undisclosed letter, Department of Treasury attorneys concluded that the administration is not required to provide the watchdogs with information about the beneficiaries of programs like the $500 billion in loans for corporations.
Treasury Secretary Mnuchin refused to provide Congress with the names of recipients of the taxpayer-funded coronavirus business loans. After criticism, Mnuchin began to walk back his denial, saying he will talk to lawmakers on a bipartisan basis “to strike the appropriate balance for proper oversight” of PPP loans “and appropriate protection of small business information.”
At least 4 lawmakers have benefited in some way from the Paycheck Protection program they helped create. Politico has been told there are almost certainly more -- but there are zero disclosure rules, even for members of Congress.
  • Republicans on the list include Rep. Roger Williams of Texas, a wealthy businessman who owns auto dealerships, body shops and car washes, and Rep. Vicky Hartzler of Missouri, whose family owns multiple farms and equipment suppliers across the Midwest. The Democrats count Rep. Susie Lee of Nevada, whose husband is CEO of a regional casino developer, and Rep. Debbie Mucarsel Powell of Florida, whose husband is a senior executive at a restaurant chain that has since returned the loan.
Mick Mulvaney dumped as much as $550,000 in stocks the same day Trump assured the public the US economy was 'doing fantastically' amid the COVID-19 outbreak. Mulvaney unloaded his holdings in three different mutual funds, each of which is primarily made up of US stocks. The next day, the value of the mutual funds tanked.

Cases rising in many states

Good summary: There was supposed to be a peak. But the stark turning point, when the number of daily COVID-19 cases in the U.S. finally crested and began descending sharply, never happened. Instead, America spent much of April on a disquieting plateau, with every day bringing about 30,000 new cases and about 2,000 new deaths. This pattern exists because different states have experienced the coronavirus pandemic in very different ways…The U.S. is dealing with a patchwork pandemic.
As of Friday, coronavirus cases were significantly climbing in 16 states: Alabama, Arizona, Arkansas, Florida, Georgia, Louisiana, Mississippi, Nevada, North Carolina, Oklahoma, Oregon, South Carolina, Tennessee, Texas, Utah, and Washington.
Oklahoma is experiencing a massive increase in coronavirus cases just days before Trump’s planned rally in Tulsa. In Tulsa county itself, 1 in roughly 390 people have tested positive. Yet Trump plans on cramming 20,000 people in an event with voluntary face mask policy and no social distancing. Attendees must sign a waiver that absolves the president’s campaign of any liability from virus-related illnesses.
  • On Monday, Pence lied saying that Oklahoma has “flattened the curve.” As you can see at any of the resources immediately below, this is not even close to true. Over the past 14 days, the state has seen a 124% increase in cases and reports 65% of ICU beds are in use.
  • Tulsa World Editorial Board: This is the wrong time and Tulsa is the wrong place for the Trump rally. "We don't know why he chose Tulsa, but we can’t see any way that his visit will be good for the city...Again, Tulsa will be largely alone in dealing with what happens at a time when the city’s budget resources have already been stretched thin."
  • Earlier in the day, Trump tweeted that he is a victim of double standards when it comes to perception of his decision to resume campaign rallies in the midst of the coronavirus pandemic, declaring that attempts to “covid shame” his campaign “won’t work!”

Aside from the fact that cases exist even if we don’t test for them, we cannot explain the rising number of cases by increased testing capacity: In at least 14 states, the positive case rate is increasing faster than the increase in the average number of tests.
  • Reminder: In March Trump told Fox News that he didn't want infected patients from a cruise ship to disembark because it would increase the number of reported cases in the US. "I like the numbers being where they are," Trump said at the time. "I don't need to have the numbers double because of one ship that wasn't our fault."

Equipment and supplies

More studies prove wearing masks limits transmission and spread of coronavirus… One study from Britain found that routine face mask use by 50% or more of the population reduced COVID-19 spread to an R of less than 1.0. The R value measures the average number of people that one infected person will pass the disease on to. An R value above 1 can lead to exponential growth. The study found that if people wear masks whenever they are in public it is twice as effective at reducing the R value than if masks are only worn after symptoms appear.
Meanwhile, Trump officials refuse to wear masks and Trump supporters copy his behavior… VP Mike Pence, leader of the coronavirus task force, published a tweet showing himself in a room full of Trump staffers, none wearing masks or practicing social distancing. Pence deleted the tweet shortly after criticism. A poll last week showed that 66% of likely-Biden-voters “always wear a mask,” while 83% of likely-Trump-voters “neverarely wear a mask.”
  • Trump’s opposition to face masks hasn’t stopped him from selling them to his supporters, though. The online Trump Store is selling $20 cotton American flag-themed face masks.
  • Yesterday, we learned that South Carolina Republican Rep. Tom Rice and family have tested positive for the coronavirus. Just two weeks ago, Rice was on the House floor and halls of the Capitol without wearing a mask.
Internal FEMA data show that the government’s supply of surgical gowns has not meaningfully increased since March… The slides show FEMA’s plan to ramp up supply into June and July hinges on the reusing of N95 masks and surgical gowns, increasing the risk of contamination. Those are supposed to be disposed of after one use.
Nursing homes with urgent needs for personal protective equipment say they’re receiving defective equipment as part of Trump administration supply initiative. Officials say FEMA is sending them gowns that look more like large tarps -- with no holes for hands -- and surgical masks that are paper-thin.
More than 1,300 Chinese medical-device companies that registered to sell PPE in the U.S. during the coronavirus pandemic used bogus registration data… These companies listed as their American representative a purported Delaware entity that uses a false address and nonworking phone number.
Florida is sitting on more than 980,000 unused doses of hydroxychloroquine, but hospitals don’t want it… Gov. Ron DeSantis ordered a million doses of the drug to show support for Trump, but very few hospitals have requested it.

Native American communities struggle

The CARES Act money for Native American tribes, meant to assist people during the pandemic, came with restrictions that are impeding efforts to limit the transmission of the virus. For instance, the funds can only be used to cover expenses that are "incurred due to the public health emergency." On the Navajo Nation, the public health emergency is inherently related to some basic infrastructure problems. 30% of Navajo don’t have running water to wash their hands, but the money can’t be used to build water lines.
Federal and state health agencies are refusing to give Native American tribes and organizations representing them access to data showing how the coronavirus is spreading around their lands, potentially widening health disparities and frustrating tribal leaders already ill-equipped to contain the pandemic. The Centers for Disease Control and Prevention has turned down tribal epidemiologists’ requests for data that it’s making freely available to states.
A Hospital’s Secret Coronavirus Policy Separated Native American Mothers From Their Newborns… Pregnant Native American women were singled out for COVID-19 testing based on their race and ZIP code, clinicians say. While awaiting results, some mothers were separated from their newborns, depriving them of the immediate contact doctors recommend. New Mexico Gov. Michelle Lujan Grisham announced that state officials would investigate the allegations.

Former IG Steve Linick told Congress he was conducting five investigations into Secretary of State Mike Pompeo and the State Department before he was fired. In addition to investigating Pompeo's potential misuse of taxpayer funds and reviewing his decision to expedite an $8 billion arms sale to Saudi Arabia, Linick’s office was conducting an audit of Special Immigrant Visas, a review of the International Women of Courage Award, and another review "involving individuals in the Office of the Protocol."
  • Pompeo confidant emerges as enforcer in fight over watchdog’s firing: Linick testified that Undersecretary of State for Management Brian Bulatao, a decades-old friend of Pompeo’s, “tried to bully [him]” out of investigating Pompeo.
Trump has empowered John McEntee, director of the Presidential Personnel Office, to make significant staffing changes inside top federal agencies without the consent — and, in at least one case, without even the knowledge — of the agency head. Many senior officials in Trump's government are sounding alarms about the loss of expertise and institutional knowledge.

Courts and DOJ

The Supreme Court declined on Monday to take a closer look at qualified immunity, the legal doctrine that shields law enforcement and government officials from lawsuits over their conduct. Developed in recent decades by the high court, the qualified immunity doctrine, as applied to police, initially asks two questions: Did police use excessive force, and if they did, should they have known that their conduct was illegal because it violated a "clearly established" prior court ruling that barred such conduct? In practice, however, lower courts have most often dismissed police misconduct lawsuits on grounds that there is no prior court decision with nearly identical facts.
The Supreme Court ruled that federal anti-discrimination laws protect gay and transgender employees. Justice Neil M. Gorsuch and Chief Justice John G. Roberts Jr. joined the court’s liberals in the 6 to 3 ruling. They said Title VII of the Civil Rights Act of 1964, which prohibits discrimination “because of sex,” includes LGBTQ employees.
  • Alito, writing more than 100 pages in dissent for himself and Thomas, accused the court's majority of writing legislation, not law. Kavanaugh wrote separately: "We are judges, not members of Congress...Under the Constitution and laws of the United States, this court is the wrong body to change American law in that way."
  • Just days before the SCOTUS opinion was released, the Trump administration finalized a rule that would remove nondiscrimination protections for LGBTQ people when it comes to health care and health insurance. The SCOTUS ruling may make it easier to challenge the changes made by Trump.
The Supreme Court also declined to take up California’s “sanctuary” law, denying the Trump administration’s appeal. This means that the lower court opinion upholding one of California's sanctuary laws is valid, limiting cooperation between law enforcement and federal immigration authorities. Justices Clarence Thomas and Samuel Alito, two of the Court's conservative members, supported taking up the case.
A federal appeals court appeared unlikely Friday to stop a judge from examining why the Justice Department sought to walk away from its prosecution of Michael Flynn. "I don't see why we don't observe regular order," said Judge Karen Henderson. "Why not hold this in abeyance and see what happens?" Judge Robert Wilkins told Flynn's lawyer that if Sullivan doesn't let the government drop the case, "then you can come back here on appeal."

  • NJPW was thrown into chaos this week when Keiji Muto, Satoshi Kojima, and IWGP Jr. Heavyweight champion Kendo Kashin all abruptly quit the company, along with 5 of NJPW's front office employees, and are headed to AJPW. Needless to say, this immediately killed the working relationship between the two companies and NJPW is already attempting to forge a new partnership with NOAH. There's also said to be a significant power struggle within NJPW right now behind the scenes that will likely be straightened out whenever Inoki returns to Japan (he's in Los Angeles right now). Tatsumi Fujinami is NJPW president but in the wake of losing these big stars, and the disappointing TV ratings for the Jan. 4th show, it's rumored his days may be numbered. There's rumors that Inoki may take over the role for the first time since he was forced out of the position back in 1983 (long story, bunch of financial scandals, Google is your friend here). Muto is currently half of the IWGP tag team champions and they were scheduled to defend the titles next month and he volunteered to still work the show, but NJPW wasn't having that so that won't be happening now and the titles will instead be vacated, along with the Jr. title Kashin held. And of course, the IWGP title is also currently vacant due to Fujita's injury, so all of NJPW's top titles are vacant right now (the only other active title is the Jr. tag belts, held by Gedo and Jado).
  • Lots of rumors floating around about how this happened, but the gist appears to be that Hiroshi Hase was the architect (no Seth) behind this whole thing. Reportedly, Muto (and maybe some of the other people who left) may be purchasing a stake of AJPW from Motoko Baba so he'll have some ownership say. The long-term idea is that Mrs. Baba will step down in a few years and Muto, who by then should be ready to retire (lol) will take over the role as AJPW president. Of course, that was the original plan for Misawa after Giant Baba died, but he and Motoko Baba couldn't get along and Misawa eventually left and formed NOAH instead. It's also worth noting that Kashin in particular wasn't thrilled about doing shoot fights while working in NJPW, but felt pressured to by Inoki and he reportedly wanted out of the company even if the AJPW thing hadn't been an option. As for Kojima, he and Tenzan have been the best tag team pro wrestling has seen in years and from an in-ring perspective, may have been the best pure worker in NJPW so his loss is going to hurt a lot too. The office workers who left are mostly accounting and merchandising people who will be doing the same jobs for AJPW.
  • One bummer of a note here is that, before this, Muto had talked of putting together a dream match against Misawa. But as long as Motoko Baba is breathing air, an AJPW star isn't going to work with Misawa, so that's probably a dead issue (yeah, sadly we never did get that match).
  • One final note: Muto also tried to recruit NJPW rising star Hiroshi Tanahashi, who most believe has the most potential of anyone in the entire company, to jump ship with him but Tanahashi decided to stay (oh man, can you imagine how different things would be if he had gone).
  • On Raw this week, Vince McMahon teased the impending arrival of Hall, Nash, and Hogan, saying he's going to do something soon that even he will regret. Vince has reportedly caved on most of Nash's demands, including the reduced schedule. Hall will be making less money than Nash and will be given an even lighter schedule, because he's a single parent with custody of his children (and Dave questions how fucked up Dana Hall must be if SCOTT is the one who has custody). And of course, you gotta figure Hogan ain't working a full schedule, since he hasn't done that in a decade and probably ain't gonna start now. Of course, this puts WWF in the same position WCW was in a few years ago: having all the top stars working TV and not appearing on house shows, which is something WWF used to openly mock WCW for. Now they'll be doing the same thing, with the same guys. It's something that killed WCW's house show business long before the TV ratings started going down. There's also the issue of how they'll get along backstage, since many of the agents (Dave says Gerald Brisco in particular) were very vocally against bringing these guys back. And then there's John Laurinaitis, who has a lot of power backstage now and he and Nash used to butt heads constantly in WCW. So things are gonna be interesting.
  • In a bit of a surprise, Vince has also agreed to let them use the NWO name and gimmick, and that reveal was made later in the week on Smackdown when Vince talked about killing the WWF with the help of the NWO. As of now, there's no plans for Triple H to join the group. X-Pac will probably find his way into it, given his relationship and history with the group. Nash is reportedly pushing for Shawn Michaels to be involved, but Dave has heard that's unlikely because there's still some fences that need to be mended there between Shawn and some in the company. But then again, Nash has gotten his way on everything else he's asked Vince for so far, so who knows? Anyway, Hall and Nash have officially signed, but Hogan still hasn't finalized his deal as of press time, but the office has been told it's inevitable and to start making plans as if he's signed. It's expected all 3 men will probably debut at the No Way Out PPV next month.

  • The Royal Rumble is in the books and was a huge success. Critically, it was an excellent show, nothing MOTY-worthy or anything, but nothing bad at all and was a legit sellout. Coming out of the show, it appears Chris Jericho will be defending the WWF title against Triple H at Wrestlemania, though that can still change. Triple H winning the Rumble was expected but made the most sense. The Rumble match lasted just over 69 minutes (nice), surpassing the 1993 Rumble and, as far as Dave is aware, making it the longest mach in WWF history (a famous Pedro Morales vs. Bruno Sammartino match in 1972 was reported in all the newspapers as lasting 75 minutes, but it was actually only 65 so don't come at Dave with no "well actually..." bullshit)
  • The return of Mr. Perfect and him being put over like a major star (he lasted until the final 4) proves that WWF has no intention of letting any other competitor get off the ground and will nip that in the bud before it ever happens. Hennig has been available for more that a year (WCW released him before they folded) and WWF never seemed interested, but as soon as XWF came along and made him their featured star (with plans to make him the face of the company), suddenly WWF swooped him up. Hennig's appearance was meant to be a one-off but it was known they were likely going to offer him a deal if he was impressive, and they have. It may not be a huge get for WWF, but it's a massive loss for XWF and pretty much renders their entire first set of TV tapings meaningless now, and Dave says that was precisely the point. Vince left the door open for competition once before and it nearly killed him. He won't make that mistake again (not until 2019 anyway). Dave says to let this be a lesson to any new promotion trying to start up: make sure you have people signed.
  • Other notes from Royal Rumble: Goldust, who was also a one-off for the match, is expected to sign a full-time deal as well. FlaiVince street fight was way better than it had any right to be considering it was between two guys over 50, one of whom isn't even a trained wrestler and the other hasn't wrestled in nearly a year since the final Nitro. Jericho retained the title over Rock in an excellent match and Dave notes that no one in the history of wrestling with the kind of main event star power Rock possesses has ever done as many jobs as him. Maven dropkicking Undertaker out of the Rumble match was the biggest pop of the entire show. But then Undertaker spent the next several minutes beating poor Maven nearly to death, lest anyone think Undertaker was actually trying to get this kid over or anything. Overall, Dave thinks it was the best Rumble match in several years.

  • The tradition of Memphis wrestling on WMC-TV has been revived! Sorta. The show, dating back to the 70s, has been off the air since last spring when the TV station refused to allow them to tape shows in their studio anymore. For the next few months, they aired a bunch of "Best of" shows but those eventually stopped in December and they've been airing infomercials in that time slot ever since. But this week, a show featuring Jerry Lawler and Brian Christopher in the main event, taped at a nearby casino in Tunica, MS aired on the channel in the usual Saturday morning time slot. Dave says the production quality was garbage and there was no local publicity for it, so it probably did a terrible rating, but it's something (pretty much just one last dying gasp, this doesn't lead to anything).
  • Carlos Colon said he's going to cut back on being an active wrestler because he wants to spend more time with his kids. Dave points out that most of his kids are wrestlers in his company, so maybe he's actually trying to get away from them.
  • NJPW star Minoru Tanaka announced his engagement to former women's wrestler Yumi Fukawa, who retired last year (did some research and they're still married to this day. Tanaka still wrestles in NOAH and Fukawa is an actress in Japan).
  • Atsushi Onita, who has been issuing grandstand challenges to Antonio Inoki for months with no response, has now challenged Naoya Ogawa for a match and wants it to be a benefit show in Afghanistan for the kids there. Dave says don't hold your breath for that one either. Onita says if he beats Ogawa, he wants the match with Inoki. Again, none of this is happening, just Onita trying to work his own angle. Neither Inoki nor Ogawa want anything to do with him.
  • Goldberg participated in a charity golf tournament this week and while there, he made some comments about going to the WWF. "I personally believe that everything I've stood for when I got into the ring would be compromised and succumbed to the circus-like atmosphere that's out there, and that's putting it mildly. I would be an imbecile if I gave up half my money to work for a company I didn't respect." Dave wonders if his tune will change when that WCW contract money dries up (yup). Also, at the same tournament, they did a funny little angle with Goldberg throwing his caddie into a lake.

  • Superstar Billy Graham has reportedly lost nearly 60 pounds in just 3 weeks, most of it water weight due to edema he's suffering from and all the other liver issues he's currently dealing with.
  • Bruno Sammartino did an interview talking about the role he has in a new low-budget movie called Saloonatics where he plays a mob guy with cancer. Sammartino talked about how uncomfortable he was with all the profanity his character had to say but he eventually got more comfortable with it and was able to put aside his personal feelings and eventually was okay with it. (No idea where the full movie is, but here's a trailer and yeah this shit is LOOOOOOOW budget).

  • Former WCW announcer Mark Madden is in some controversy in Pittsburgh, where he hosts a daily sports talk show on the local ESPN radio station there. A few weeks back, the sports media in the city was swirling with rumors about NFL star Kordell Stewart's sexuality. Madden went on his radio show and criticized people who were spreading those rumors. A writer who works at the radio station then went on the air and accused Madden of being one of the main people who fueled those rumors and claimed Madden had said things in the past on his show implying that Stewart is gay. Madden denied ever saying that, demanded the guy find the tapes to prove he ever said it, and basically felt like the guy ambushed him live on the air with the accusations. The radio station apparently agreed because the writer was fired when he refused to apologize (for what it's worth, several people have made accusations about Stewart being gay over the years and he's always denied them, and even successfully sued someone a few years ago for claiming he had a relationship with him. Who knows and who cares? Not anybody's business anyway).
  • Jake Roberts was on a radio talk show in England recently and said some interesting stuff. Said he plans to stay in the UK for the next 2 years. Said he could walk back into the WWF and have a writing job tomorrow if he wanted it. Dave scoffs at that and says I guess he prefers wrestling in front of empty indie show crowds in England instead of earning a steady paycheck. Jake also talked about the scene in Beyond The Mat where the movie alleges that Roberts asked an indie promoter for crack cocaine as his payoff for working the show. Roberts denied it happened and said he doesn't trust a promoter with anything, so he wouldn't trust one to get him crack. Well okay then. Claimed he left the WWF last time because he wasn't comfortable with the angle he was doing with Jerry Lawler, feeling like they were exploiting his sobriety. Dave pretty much rolls his eyes at all this, because Jake was actually fired for going on a bender and no-showing a bunch of events (I'm glad we all love Jake now, but he was still 1000% full of shit and off the deep end during this period).
  • Iron Shiek missed an appearance on the Opie & Anthony radio show this week because he was detained for several hours at the airport. Turns out he wore his curly toed wrestling boots on the plane and because this is 4 months after 9/11 and only 1 month after the attempted shoe-bomber, and let's be honest, simply because Iron Shiek is Middle Eastern, people freaked out. And when they wanted to examine his boots, he initially refused to let them and, well, you can imagine how well that went over with airport security.
  • If WWA's PPV in Las Vegas happens next month, Bret Hart has agreed to reprise his role as the on-screen commissioner. As best Dave can tell, no one else has really been signed on for the show and the MGM Grand doesn't know anything about this alleged plan to hold the event in their arena and in fact, WWA hasn't even applied with the Nevada commission to get a license to run a show anywhere in the state and it's almost certainly too late to get one by the scheduled date. So Dave is skeptical that this even happens, and if it does, he can't see it being in Las Vegas. (Surprisingly, it does happen and it is in Vegas, but we'll get there.)
  • Speaking of the Nevada athletic commission, XWF brought a bunch of wrestlers and a wrestling ring to the National Association of Television Program Executives conference in Vegas, with hopes of putting on a live show and impressing all the TV execs and trying to secure a TV deal. But the XWF didn't get permission from the Nevada commission, so they weren't allowed to use the ring and do a show. Whoops.
  • Speaking of XWF, morale is in the dumps in that company right now. Losing both Hulk Hogan and Curt Hennig (neither of whom were signed but had been working with them) as well as Sting reportedly not being interested has killed a lot of the excitement about the promotion for people within it.
  • Notes from Raw: Flair cut an emotional promo about his history in wrestling and how he was on the road so much and put wrestling ahead of his family and not seeing his kids and all that stuff. During the promo, Lawler made a sarcastic joke about Flair needing to have his priorities in order, which Dave thinks is pretty rich coming from Lawler, who lived the exact same life and wasn't much of a father to his kids either (which Lawler has admitted, to be fair). They're continuing to tease a Triple H/Stephanie split, with him being annoyed at her nagging. Speaking of Triple H, Dave thinks he needs to lose at least 15 pounds because he's totally slow and lumbering since he came back.
  • Notes from Smackdown: AJ Styles worked a dark match, losing to Rico Constantino, but apparently he looked awesome in the match (yeah he hits an awesome shooting star to the floor late in the match). And the show ended with McMahon doing the big NWO reveal on the back of his chair during his promo.

  • Regarding Triple H's match on Smackdown last week, where they gave away his return match on free TV 3 days before the Rumble. Remember how Dave was flabbergasted that they would be so short-sighted? Turns out Triple H felt the same way and fought hard against it, but Vince wouldn't budge.
  • Chris Benoit is telling people he expects to be back in the ring around June (yup).
  • Jim Ross answered some questions at a press thing last week and had lots of interesting stuff to say. He said the criticism WWF was receiving for bringing in Hall, Nash, and Hogan hurts, but they have to do what's best for the company and Vince feels this is it. Doesn't sound like JR loves the idea too much either. They've had no talks with Scott Steiner. When told of Goldberg's recent comments (mentioned above), he said he wanted to believe Goldberg hadn't really said that and thought it was a shame. Said there's heat on Jeff Jarrett for how he left the WWF last time so he probably won't be welcomed back anytime soon. JR also hinted that the brand split will come after Wrestlemania and implied that they will be reviving the cruiserweight division. Dave says he's convinced that Vince will never get behind pushing cruiserweights as major stars so he's not holding out hope for that. Said they may bring in Rey Mysterio if they decided to launch a cruiserweight division. Said they'd love to have Eddie Guerrero back but he has to get his personal issues straightened out first. Same with Shawn Michaels, plus they don't know if he could physically do it.
  • ESPN's Bill Simmons wrote an article reviewing Royal Rumble 2002 and Dave thinks it was great. In one piece, Simmons managed to pretty much sum up all of WWF's recent problems while still acknowledging that the show was entertaining. And the link Dave posted for it in 2002 still works!

  • Unless things change, Chris Jericho is gonna be in an awkward situation next week. Jericho is scheduled to play in a celebrity hockey game as part of NHL All Star Weekend. Who will his celebrity coach be, you ask? Goldberg. As of press time, most people in WWF don't seem to be aware of it and Dave wouldn't be surprised if Jericho gets pulled from it.
  • Booker T was on the Howard Stern show (after his comments last week saying he wasn't a fan of Stern, go figure) and talked about his time in prison and his plans to write a book. He also said he hopes to retire in 2 years which Dave ain't buying (yeah, still about 10 years away from that). He also said someone is suing him over the term "Spinaroonie" because apparently someone else thinks they own the rights to that name. Dave notes that they've been dating since WCW and Booker is the one who helped her get hired by WWF, where she's currently in developmental.
  • DDP has also said he plans to retire in 2 years, to become a motivational speaker. This one actually almost happened. He left WWF just 3 months after this and didn't wrestle at all for several years. Then he had a brief run in TNA but he's been mostly retired other than some one-offs ever since.
  • Randy Orton is moving up to the main roster. In his final OVW match, Orton lost clean to Prototype and Dave says it's clear they're grooming Prototype to be the next OVW champion.

Shortly before the band came on stage guitarist Rob Harris tweeted 'About to perform I Shinjuku. Closing down a street, pandemonium.'

The band were shocked and saddened when told the news, and out of respect immediately felt the right decision was to cancel the show. A police investigation is taking place which would also have prevented the show from happening. We know how disappointed fans will feel, but can only say at this point, the gig will be re-arranged and we will have news of the revised date as soon as possible.

Jay Kay would like to apologise to disappointed fans for the cancellation of last night's show in France. Jay's on-going groin injury has been diagnosed as a hernia which will be need to be operated on later in the summer. Following an MRI scan last week specialists had advised rest but Jay has insisted he wants to try to finish the current run of dates. Doctors have said that provided he manages the pain sufficiently he can continue performing if he feels able. During the course of the past two days the pain flared up again and yesterday he reluctantly decided he did not feel he well enough to perform last night. After two days rest he is hopeful he will be able to complete the remaining 4 shows of the current run, including Toulon tomorrow night. Jay said "I would like to thank fans for their understanding, this is a very frustrating injury and some days the pain is just too extreme to perform to a standard I believe is acceptable. I promise I will do my best to come back out again soon when I'm fully fit and am optimistic I'll be able to pull off the remaining shows of the run."
